1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "Fan", or "User") and TRUE FAN ("TRUE FAN", "we", "us", or "our"), a division of Dirty Bucks. By browsing our website, creating an account, ordering merchandise, or redeeming digital collectibles, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all terms, you must discontinue use of the platform immediately.

2. The TRUE FAN Platform & Drops

TRUE FAN provides a premier direct-to-fan commerce experience combining physical streetwear merchandise with authenticated digital moments created in partnership with world-class artists, musicians, and athletes. Products marked as "Wear + Unlock" include a physical garment accompanied by a unique, numbered hangtag claim code. Redeeming this code unlocks exclusive media content (audio recordings, performance films, behind-the-scenes vault footage) and a serialized digital collectible.

3. Eligibility & User Accounts

You must be at least 18 years old or the age of legal majority in your jurisdiction to make purchases on TRUE FAN. If you are between 13 and 18 years of age, you may use the site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

While guest checkout is available, creating an account allows you to securely store your shipping details, order history, and digital collectible claims. You are responsible for safeguarding your login credentials. TRUE FAN cannot be held liable for unauthorized access resulting from compromised user passwords.

4. Orders, Pricing & Stripe Checkout

All prices are displayed in U.S. Dollars (USD) unless specified otherwise. We reserve the right to correct typographical pricing errors prior to order fulfillment. Your order represents an offer to purchase; an order is only accepted once payment authorization is confirmed and a dispatch notification or order confirmation is issued.

Payment processing is handled securely by Stripe. We do not store your raw credit card or banking details on our servers. Applicable sales taxes, duties, and shipping fees are calculated at checkout based on the destination address.

5. Shipping & Risk of Loss

Merchandise is fulfilled through trusted commercial carriers (such as USPS, UPS, FedEx, or DHL). Standard shipping typically arrives within 4 to 7 business days, while Express shipping arrives within 2 to 3 business days. Title and risk of loss for physical goods transfer to you upon carrier receipt.

For international shipments, you are the importer of record and are responsible for all customs duties, tariffs, and import VAT assessed by your local authority.

6. Returns & Cancellation Policy

Because our collections are strictly limited editions produced in numbered series, returns and cancellations are governed by the following criteria:

• Unredeemed Items: You may request a return within 14 calendar days of delivery, provided the garment is unworn, unwashed, with all original tags attached, and the claim code scratch-off or security seal remains completely unrevealed.
• Claimed Digital Codes: Once a digital unlock code has been redeemed on the platform, the order becomes non-refundable and final sale, as the serialized digital collectible has been permanently activated.
• Defective or Damaged Merchandise: If an item arrives damaged or defective, notify us within 7 days at support@dirtybucks.biz with photos for an expedited replacement or refund.

7. Digital Collectibles & Media License

When you redeem an unlock code, TRUE FAN grants you a limited, personal, non-exclusive, non-sublicensable, and revocable license to access, view, and stream the associated media content and digital collectible card for personal, non-commercial enjoyment.

You may not: (a) duplicate, redistribute, broadcast, or publicly perform unlocked audio or video content; (b) rip, scrape, reverse-engineer, or circumvent encrypted media URLs; (c) mint, fractionalize, or commercially exploit digital collectibles without express written authorization from TRUE FAN and the talent.

8. Claim Codes & Security

Each claim code is unique and single-use. Codes are tied to specific product editions and issue one serialized digital card (e.g., #0042 of 100). Once claimed, the code cannot be transferred to another user unless supported through official platform features.

TRUE FAN reserves the right to void or revoke any claim code acquired through theft, fraud, unauthorized secondary reselling, or manipulation of our servers.

9. Anti-Botting & Prohibited Conduct

To ensure fair access for authentic fans, we maintain rigorous bot-prevention measures. The following activities are strictly prohibited:

• Deploying automated checkout bots, scripts, or headless browser automation to bypass queue systems.
• Creating multiple accounts or using proxies to exceed published per-customer quantity limits.
• Denial-of-service attacks, rate-limit bypassing, or unauthorized vulnerability probing.
• Harvesting platform data, pricing, or talent assets using automated web spiders.

Violations will result in immediate cancellation of orders, permanent account bans, and potential legal referral.

10. Intellectual Property Rights

All content on TRUE FAN—including graphics, logos, product designs, garment typography, photography, audio compositions, videos, software code, and UI elements—is owned by or licensed to TRUE FAN, Dirty Bucks, or our collaborating talent (including Nova Rae and Malik Rivers). Nothing in these Terms transfers copyright, trademark, or patent ownership to you.

11. Disclaimer of Warranties

THE TRUE FAN PLATFORM AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT DIGITAL STREAMING MEDIA WILL BE UNINTERRUPTED OR ERROR-FREE AT ALL TIMES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRUE FAN, DIRTY BUCKS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR PARTNER TALENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM OR PURCHASED GOODS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

13. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You agree to resolve all disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law & Severability

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.
